Your legal rights are protected under Organic Law No. 2017-10 of March 7, 2017.
You may report corruption as defined in Article 2 of the law, including concussion in all its forms, misappropriation of public funds, poor management or dissipation of public funds, trafficking in influence, excess or abuse of authority, all cases of illicit enrichment, breach of trust, abuse of corporate assets, money laundering, conflict of interest, insider trading, tax evasion, obstruction of judicial decisions, and any facts threatening public health, security, or the environment.
The Constitutional Authority, as an independent constitutional body under Article 2(5) of the law, is statutorily obligated under Article 3 to ensure proper execution of this law.
We receive and investigate all reports in good faith, with your identity kept strictly confidential.
All data processing complies with Article 5 of the law and applicable personal data protection legislation. Reports are examined within thirty days, extendable to sixty days per Article 13.
Written decisions are communicated to you per Article 14.
Under Organic Law No. 2017-10, you have the right to report corruption without revealing your identity. Your identity remains strictly confidential throughout all stages of investigation, and anyone who discloses it faces imprisonment from one to five years.
You are protected from dismissal, harassment, discrimination, or any retaliatory action because of your report. If you face any administrative measure following your report, the responsible authority is legally obligated to prove that the measure was not a result of your report.
Anyone who takes retaliatory action against you faces imprisonment from six months to two years, and if the action causes serious harm, the penalty increases to ten years. You have the right to free legal assistance and psychological support if you need it.
If criminal conduct is identified, reports are referred to the competent prosecutor. If disciplinary violations are identified, reports are referred to the appropriate disciplinary authority.
